Jess M. Collen Speaks in Montreal at Italian Chamber of Commerce
On September 25, 2008 Jess Collen had the pleasure of speaking on
United States Intellectual Property at a workshop for Italian delegates in Montreal.

The workshop was hosted by the Italian Chamber of Commerce in Canada. The presentation given by Mr. Collen was intended not only for the seasoned business professionals with a base of knowledge already established, but also to be unambiguous for the newcomers to the field of Intellectual Properties.

The overall purpose of the program was to give a substantial understanding of the rights and business prospects afforded to Intellectual Property in North America. Specific topics included trademarks, copyrights, domain names, industrial designs, integrated circuit topographies and patents in their prosecution, maintenance, protection, assignment, licensing and litigation.

Collen IP Offers Attorneys New Directions
July 10, 2008: Collen IP panelists presented an overview of intellectual property law at Pace University School of Law’s “New Directions” Continuing Legal Education program, aimed at attorneys re-entering legal practice. Partner, Matthew Wagner, lectured on trademark law, trade secrets, and non-disclosure and non-compete agreements. Matthew was joined by Jenny Slocum, associate, who addressed false advertising and patent law. The presentation invited discussion between the panelists and participants over the theoretical and practical considerations in intellectual property law.

Jess Collen Speaks at Conference in Vienna
Jess M. Collen, a Partner at Collen IP, was in Vienna in May, where he spoke to a group of international corporate and commercial lawyers about trademark law practice in the United States, with a focus on recent developments in practice before the United States Patent and Trademark Office. The program included Dr. Hans Winkler, the State Secretary for the Foreign Ministry in Austria. The program also included a round table discussion on issues involving legal practice in the United States, Europe and Asia.

October 14, 2007: Partner Matthew Wagner, and Associates Jeffrey Lindenbaum and Douglas Pulitzer lectured at the Pace Law School Center for Continuing Legal Education on the topic of Intellectual Property Basics and Trends. The Collen IP panel addressed recent trends and provided fundamentals on the cornerstone intellectual property sectors, including patents, trademarks, copyrights, trade secrets and internet disputes.


Jess M. Collen Lectures at the International Trademark Association Annual Meeting
May 2, 2007: Jess M. Collen was a panelist at the 2007 Annual Meeting of the International Trademark Association in Chicago, Illinois. Jess addressed the ethical issues facing U.S. litigators during the discovery phase of a lawsuit, addressing recent decisions and trends in discovery, and highlighting some of the “gray” areas where there is little or no guidance from controlling or advisory precedent.
Collen IP Conducts CLE Seminar On Counterfeit Seizures
January 30, 2007: Several attorneys from Collen IP lectured at the Pace University School of Law Center for Continuing Legal Education taking attendees through a mock application for a counterfeit seizure. The lecture was moderated by Partner Jane F. Collen and included separate presentations by attorneys Jeffrey Lindenbaum, Brendan Reilly, Joanna Gerson, and Jenny Slocum.
The program was aimed at sharing techniques to obtain a successful seizure, as well as informing our colleagues of various ethical and legal perils involved in obtaining and executing such extraordinary relief. The lecture incorporated not only the controlling legal precedent supporting this relief, but also included practical tips from the attorneys' extensive experience of successful execution of ex-parte seizures of counterfeit products.

Matthew Wagner Co-Chairs Seminar on Intellectual Property and Employment Agreements
Partner, Matthew Wagner co-chaired a seminar on “The Corporate and Intellectual Property Perspective on Agreements Relating to Employment,” which was hosted by the Westchester County Bar Association. The seminar included discussions of non-compete and non-disclosure agreements: these issues have arisen in at least two Collen IP lawsuits which are currently active.
Collen IP Associates Lecture at Pace University School of Law
Jenny T. Slocum, Joanna B. Gerson, and Brendan J. Reilly participated in an Intellectual Property Panel discussion at Pace University School of Law. Ms. Slocum discussed the ramifications of the recent Blackberry patent infringement lawsuit and whether permanent injunctions should automatically issue in a patent action once infringement is found. Trademark infringement by typosquatters was the focus of Ms. Gerson’s presentation. Mr. Riley addressed corporate strategies against gray market goods.

Collen IP Hosts an Emerging Issues Seminar at Pace University Law School Continuing Legal Education
October 2004 - Jane F. Collen assembled and chaired a seminar at Pace University on Wednesday, October 6, 2004. The topic was emerging issues in intellectual property. At the seminar, a panel of experts discussed the many issues and aspects of counterfeiting trademarked goods.

Beginning this seminar with a quick overview of recent issues that have emerged through the Appeals Court decisions, Jane Collen reviewed and commented on the Ninth Circuit Decision on the sale of trademarks as keywords by search engines. The 9th Circuit recently held that the sale of trademarks by search engines as key words to competitors of the trademark owner is trademark infringement when the banner ads which appear to the Internet user along with the results of their search are not clearly labeled as to the source or sponsor of the ad. Mrs. Collen also discussed the recent decision holding makers of peer-to-peer file sharing software do not contributorily or vicariously infringe copyright law.

An accountant from Deloitte & Touche, Yogesh Bahl, began the presentation on counterfeiting by briefly outlining its traditional forms. Mr. Bahl discussed his experience in measuring the devaluation of brands caused by counterfeiting. Bringing to the table his experience in investigating counterfeiting, determining the roots of problems, and the effect that it has on the brand, Mr. Bahl outlined the many ways to evaluate the marketplace and the effect of counterfeiting on the international market.

The focus of the discussion then turned to the new market for counterfeit goods, the Internet. Jess M. Collen and Matthew C. Wagner, partners at Collen IP led the discussion of the “replica” industry and its effect on trademarks and brands around the world. Mr. Wagner took the seminar through the practical aspects of filing a counterfeiting lawsuit. He outlined the many steps necessary and the documentation required in order to prevail in court.
Then, John Bergen, Chief Trademark and Copyright Counsel at Avon Products, Inc., further illustrated the problem of counterfeiting, and its ramifications around the world. Mr. Bergen’s experience in trying to protect the Duracell brand, during his years at Union Carbide, as Chief Trademark and Copyright Counsel, demonstrated the way counterfeiters can capitalize on the markets in different countries through their knowledge of and infiltration of the manufacturing and distribution chain of the brand owner.

Collen IP Leads CLE Program on Intellectual Property Law
January 2003 - Partners, Jane F. Collen, Jess M. Collen, James R. Hastings, and Matthew C. Wagner, were key speakers at a recent continuing legal education program in New York on intellectual property and litigation that focused on the development, procurement and enforcement of brands and trademarks. Jane F. Collen coordinated and moderated the event, at which Jess M. Collen spoke on trademark law and the essentials of prosecution before the U.S. Patent and Trademark Office and litigation. Matthew C. Wagner discussed jurisdictional issues, including emerging law concerning cyber activities and trademark infringement over the internet. Rounding out the panel, James R. Hastings talked about the practical aspects of enforcement of intellectual properties on the internet. The Honorable Colleen McMahon, United States District Judge for the Southern District of New York, provided a most enlightening “view from the bench”. The event was very well attended and well received in the community.
